Terms and Conditions

1. Contracting parties

This agreement is made between Lilium Digital OÜ ("Service Provider"), registered in Estonia, and the individual or company ordering the service ("Client").

2. Description of service

The Service Provider designs and hosts a professional website for the Client’s business. The standard service covers one (1) website built and delivered within 7 business days of receiving the completed intake form and payment.

3. Price and payment

• Setup fee: €80 one-time, non-refundable except in the case described in the Refund Policy.
• Monthly fee: €20/month, billed automatically via Stripe.
• First payment: €100 (€80 + first month €20) charged at checkout.
• All prices include VAT where applicable under Estonian and EU law.

4. Delivery

• Delivery takes place within 7 business days of receiving the completed intake form.
• "Delivery" means a live URL (link) provided to the Client.
• The Client must complete the intake form within 14 days of payment, or the order may be cancelled without refund.

5. Domains

• Client provides their own domain: the Client is responsible for DNS configuration. Lilium Digital OÜ provides DNS instructions.
• Lilium Digital OÜ purchases the domain on behalf of the Client: a one-time €5 admin fee applies in addition to the domain registration cost (billed at cost, no markup on the domain price). The domain is registered in the Client’s name where possible.
• Domain transfer: if the Client cancels and requests a domain transfer, a transfer fee of €10 applies. The transfer is completed within 5 business days of the request.
• If Lilium Digital OÜ registered the domain and the Client does not request a transfer within 30 days of cancellation, the domain may be released.

6. Hosting and support

The monthly fee covers: website hosting, uptime monitoring, an SSL certificate, and up to 3 minor content changes per month (text, images, contact info).

Not included: new sections, structural redesign, additional pages, e-commerce, booking systems, SEO work. These are quoted separately.

A "minor content change" means updating existing text or images. Adding new sections is not a minor change.

7. Cancelling the subscription

• The Client may cancel at any time by email or written notice.
• Cancellation takes effect at the end of the current billing period.
• There are no penalties or cancellation fees.
• The monthly fee for the current period is not refunded upon cancellation.

8. Refunds

• The €80 setup fee is non-refundable.
• Exception: if the website is not delivered within 7 business days of the client submitting the completed intake form, the client is entitled to a full refund of the €80 setup fee.
• The €20 monthly fee is never refunded, as it covers services already rendered.

These rules are detailed in the Refund Policy, which is incorporated into these Terms by reference.

9. Intellectual property

• Upon full payment, the Client receives full ownership of the website content and design as delivered.
• Lilium Digital OÜ retains the right to display the work in its portfolio unless the Client requests otherwise in writing.
• The Client warrants that any content they provide (logo, images, text) does not infringe third-party rights.

10. Limitation of liability

• Lilium Digital OÜ is not liable for: lost revenue, business interruption, or indirect damages.
• Maximum liability is limited to the amount paid by the Client in the preceding 3 months.
• The service is provided "as is" — with no guarantee of specific business outcomes (traffic, leads, sales).

11. GDPR and data protection

The processing of personal data is described in the Privacy Policy, which is incorporated into these Terms by reference.

12. Governing law

These Terms are governed by Estonian law. Disputes are resolved in Estonian courts, except where mandatory EU consumer protection law applies.

13. Changes to the terms

Lilium Digital OÜ may update these Terms with 30 days notice by email.
