Terms and Conditions

1. Contracting parties

This agreement is made between Lilium Digital OÜ ("Service Provider"), registered in Estonia, and the individual or company ordering the service ("Client").

2. Description of service

The Service Provider designs and hosts a professional website for the Client’s business. The standard service covers one (1) website built and delivered within 7 business days of receiving the completed intake form and payment.

3. Price and payment

Monthly billing: the first payment of €100 includes €80 for setup and €20 for the first month. Subsequent payments are €20 per month. Total for the first 12 months: €320.

Annual billing: the first payment of €249 includes €100 for setup and €149 for the first 12 months. Subsequent payments are €149 per year, paid in advance for the next 12 months.

Setup is charged once. Renewal includes only the recurring subscription. Both options provide the same core package.

The final total and any applicable tax are shown in Stripe before you confirm payment.

If you select the new-domain add-on, the first payment with the monthly website plan is €115, then €20 per month for the website. The domain renews separately at €15 per year, first charged one year after purchase. With the annual website plan, the first payment including the domain is €264, followed by combined website and domain renewals of €164 per year.

4. Delivery

• Delivery takes place within 7 business days of receiving the completed intake form.
• "Delivery" means a live URL (link) provided to the Client.
• If you cannot complete the form immediately, keep your email link and continue later. The delivery period starts when complete information has been received.

5. Domains

An address like mybusiness.clematis.dev is included at no extra cost. You can add a new custom address, such as mybusiness.com, at checkout for a yearly fee. Connecting a domain you already own is included.

Connecting an existing domain is included. The Client remains responsible for domain registration and renewal with their registrar; we provide connection instructions.

The optional add-on costs €15 per year for registration and renewal of one standard domain with a .com, .net, .org, .eu extension, provided both the registrar’s registration cost and yearly renewal cost are no more than €15. Premium and higher-cost domains are excluded; any separate offer and surcharge are agreed before payment.

Before registration, our team manually checks availability and cost and agrees the name with the Client. If a name is unavailable or ineligible, we agree an eligible alternative. The domain is registered using the Client’s details as registrant. For access or transfer instructions, contact support@clematis.dev; automatic or free transfers are not part of the add-on.

6. Hosting and support

The package covers the initial creation and publishing of a simple business website, hosting, SSL and connection of an existing domain. Hosting continues throughout the paid subscription period.

Unlimited changes are not included. Later changes, additional pages, online shops, custom booking systems and extra features are separately agreed and priced before work begins.

7. Cancelling the subscription

The subscription renews automatically every month or year, depending on the selected option. Subscription management shows the next renewal date and amount.

Cancel future renewal in subscription management or by contacting support@clematis.dev. Cancellation takes effect at the end of the paid period, until which hosting remains active.

Cancelling future renewal does not itself initiate a refund of the already paid period. Mandatory statutory rights are unaffected.

Cancelling future website renewal also stops future renewals of the selected domain add-on. Domain registration that has already been paid remains valid until the end of its yearly period, even if the paid website period ends earlier.

8. Refunds

Setup costs €80 with monthly billing or €100 with annual billing. If the website is not delivered within 7 business days after the complete intake and payment are received, you may request a full refund of the setup fee.

For other refunds, including a request concerning a prepaid period, contact support@clematis.dev. We assess the request based on services performed, the contract and applicable mandatory law.

These terms do not exclude statutory consumer rights, including any applicable withdrawal right. Payment alone does not waive those rights.

9. Intellectual property

• Upon full payment, the Client receives full ownership of the website content and design as delivered.
• Lilium Digital OÜ retains the right to display the work in its portfolio unless the Client requests otherwise in writing.
• The Client warrants that any content they provide (logo, images, text) does not infringe third-party rights.

10. Limitation of liability

• Lilium Digital OÜ is not liable for: lost revenue, business interruption, or indirect damages.
• Maximum liability is limited to the amount paid by the Client in the preceding 3 months.
• The service is provided "as is": with no guarantee of specific business outcomes (traffic, leads, sales).

11. GDPR and data protection

The processing of personal data is described in the Privacy Policy, which is incorporated into these Terms by reference.

12. Governing law

These Terms are governed by Estonian law. Disputes are resolved in Estonian courts, except where mandatory EU consumer protection law applies.

13. Changes to the terms

Lilium Digital OÜ may update these Terms with 30 days notice by email.
